These terms are an agreement between you and NovelTake Media LLC (“NovelTake,” “we”), and cover the NovelTake website at noveltake.app and the NovelTake apps. By using NovelTake, you agree to them. If you don’t agree, please don’t use NovelTake.
You must be at least 13 years old. If you are under the age of majority where you live, you may only use NovelTake with the permission of a parent or guardian, who agrees to these terms on your behalf.
You’re responsible for your account and for keeping your password secure. Give us a real email address you can access. One person, one account: creating extra accounts to vote on your own takes, farm credits or referral rewards, or get around a ban is not allowed.
You can vote on takes and matchups without an account. Those votes count toward results, but don’t earn standing, credits or titles.
You own the takes, replies and other content you post. By posting, you give NovelTake a worldwide, non-exclusive, royalty-free licence to host, store, display, reproduce, distribute and adapt that content to run, improve and promote NovelTake, including showing it on our site and apps, in share images and results cards, and in our own social media posts. This licence ends when you delete the content or your account, except for copies others have already shared and copies kept in backups for a limited time.
You’re responsible for what you post, and you must have the right to post it. Everything you post must follow our Community Guidelines, which are part of these terms.
Tag spoilers using the spoiler options when you post. Untagged spoilers may be removed.
We may remove any content, and suspend or close any account, that breaks these terms or the Community Guidelines, or that we reasonably believe puts others at risk. We may use automated tools to filter certain language before it’s posted. You can report content and block other users. We aren’t obliged to monitor everything posted, and content reflects the views of the people who posted it, not NovelTake.
NovelTake awards standing, tiers, titles, credits, cosmetic items and similar rewards for taking part. These are part of the game, not property:
Any rewards we offer that involve chance, such as chests, are earned through taking part and are never sold.
Some users are creators who run matchups. Matchup results and character rankings reflect how people voted, not any official or canonical answer. Creators may be paid by NovelTake for partnerships, and are required to disclose paid partnerships where the law requires it. Creators may see combined, non-identifying numbers about activity that came through their links.
You can earn credits when people you invite take part. Referral rewards obtained through fake accounts, self-referral or other manipulation may be removed.
We send emails needed to run your account, such as confirmations and password resets. We may also send activity emails, such as replies and results, which you can turn off in Settings on your profile. In the app, push notifications are only sent if you allow them, and can be turned off in your phone’s settings.
NovelTake is an independent fan discussion platform. We are not affiliated with or endorsed by the creators, publishers or studios of any series discussed. Series titles and character names belong to their respective owners and are used only to identify what’s being discussed. Don’t post copyrighted material you don’t have the right to share. We respond to valid copyright notices under our copyright policy.
NovelTake, including its design, code, scoring and branding, belongs to us. We may change, add or remove features at any time, and may suspend or stop the service. We’ll try to give notice of major changes where we reasonably can.
You can delete your account at any time from Settings on your profile. This permanently removes your account and its content, as described in our Privacy Policy.
NovelTake is provided “as is” and “as available,” without warranties of any kind, to the fullest extent the law allows. We don’t promise it will always be available, error-free or secure, or that content posted by users is accurate.
To the fullest extent the law allows, NovelTake and its owners won’t be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, standing, credits or rewards, arising from your use of NovelTake. Our total liability for any claim relating to NovelTake is limited to the greater of the amount you paid us in the 12 months before the claim, or $50. Some places don’t allow these limits, so they may not fully apply to you.
If someone brings a claim against us because of content you posted or your breach of these terms, you agree to cover our reasonable costs and losses from that claim, to the extent the law allows.
These terms are between you and NovelTake, not Apple. Apple isn’t responsible for the app or its content, and has no obligation to provide maintenance or support for it. If the app fails to meet any applicable warranty, you may notify Apple, and Apple’s only obligation is to refund any price you paid for the app; to the extent the law allows, Apple has no other warranty obligation. NovelTake, not Apple, is responsible for any claims relating to the app, including product liability, legal or regulatory compliance, consumer protection, and intellectual property claims. You confirm you’re not located in a country subject to a US government embargo, and not on any US government list of prohibited or restricted parties. You must also follow any third-party terms that apply when using the app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
We may update these terms. If we make a significant change, we’ll let you know, for example by a notice on NovelTake or by email. Continuing to use NovelTake after a change means you accept the updated terms.
These terms are governed by the laws of the State of New Jersey, USA, without regard to its conflict-of-law rules, except where the law of the place you live requires otherwise.
